Terms of Use

These Terms of Use (“Terms”) govern your access to and use of CapShip, including the CapShip website, software, source code, templates, documentation, downloads, and related products and services.

By purchasing, downloading, accessing, or using CapShip, you agree to these Terms. If you do not agree to these Terms, you may not use CapShip.

1. CapShip Products

CapShip provides software development resources designed to help developers build applications for iOS, Android, and the web. Depending on the product purchased or downloaded, CapShip may include frontend code, backend code, authentication systems, database schemas, integrations, configuration files, components, documentation, and other development resources.

CapShip Free may be provided without charge. CapShip Pro and any other paid products are provided according to the features and terms presented at the time of purchase.

2. License Grant

Subject to these Terms, CapShip grants you a perpetual, non exclusive, non transferable license to use, copy, modify, and adapt the CapShip source code you lawfully obtain for the purpose of creating your own applications, websites, software products, and commercial projects.

You may use your licensed copy of CapShip for personal and commercial projects and may modify the code without restriction for those projects.

Except for restrictions expressly stated in these Terms, there are no royalties owed to CapShip on applications or products you create using your licensed copy.

3. Your Code and Ownership

You own what you build with CapShip.

Any original application, feature, design, business logic, content, configuration, modification, or other code that you create using your licensed copy of CapShip belongs to you.

CapShip does not claim ownership of your applications, businesses, customer data, modifications, or original work created using CapShip.

You may commercially operate, publish, sell, transfer, or otherwise exploit applications you create using CapShip, subject to these Terms and any applicable third party licenses.

The CapShip product itself, including the original CapShip source code, templates, documentation, branding, designs, and other materials provided by CapShip, remains the intellectual property of CapShip and its applicable licensors.

Purchasing CapShip transfers ownership of your resulting work to you; it does not transfer ownership of CapShip itself or grant you the right to redistribute the CapShip product as a standalone product.

4. Prohibited Uses

CapShip does not currently use advertising cookies, tracking pixels, or analytics cookies on its website. If this changes in the future, we will update this Privacy Policy and provide any notices or choices required by applicable law.

5. Third Party Software Services

CapShip may integrate with or include software, libraries, APIs, platforms, and services provided by third parties.

Third party products remain subject to their own licenses, terms, privacy policies, pricing, availability, and usage restrictions. CapShip does not own or control those third party services and cannot guarantee their continued availability, compatibility, pricing, or functionality.

You are responsible for reviewing and complying with the terms and licenses applicable to third party technologies you choose to use with your application.

6. Purchase and Payments

Paid CapShip products are currently sold through Polar, which acts as Merchant of Record and authorized reseller for applicable transactions.

Payment processing, applicable taxes, receipts, chargebacks, and certain transaction-related matters are handled according to Polar’s applicable buyer terms and policies.

Prices displayed by CapShip may change for future purchases. A price change does not affect a purchase that has already been completed.

7. Refunds

Because CapShip products may provide immediate access to downloadable digital content and source code, refunds may be limited once access has been provided.

Refund requests are handled in accordance with the refund terms presented at checkout, Polar’s applicable policies, and applicable law.

Nothing in these Terms limits any refund, cancellation, warranty, or other consumer right that cannot legally be waived.

8. Updates and Support

CapShip may provide updates, improvements, bug fixes, compatibility changes, documentation updates, or other modifications from time to time.

Unless expressly stated as part of your purchase, purchasing CapShip does not guarantee that any particular feature, integration, dependency, or third party service will be maintained indefinitely.

Support may be available through support@capship.org. The scope and availability of support may vary by product and may change over time.

Any update commitments required by applicable law remain unaffected.

9. Security and Development Responsibility

CapShip is designed using security conscious development practices and is intended to provide a strong foundation for application development. However, no software, framework, authentication system, dependency, or security measure can be guaranteed to be completely secure or free from vulnerabilities.

You are responsible for reviewing, testing, configuring, maintaining, and securing your application before and after deployment. This includes protecting credentials and secrets, configuring third party services correctly, maintaining dependencies, applying relevant security updates, and complying with the security and legal requirements applicable to your application.

CapShip does not guarantee that an application built using CapShip will automatically satisfy every security, privacy, regulatory, or compliance requirement applicable to your particular use case.

  1. Disclaimer of Warranties

To the maximum extent permitted by applicable law, CapShip and its products are provided on an “as is” and “as available” basis.

CapShip does not warrant that the software will be completely error free, vulnerability free, uninterrupted, compatible with every third party service or future software version, or suitable for every particular purpose.

We may test and review CapShip extensively before release, but software can contain defects and third party technologies can change independently of CapShip.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot be excluded under applicable law.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, CapShip will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, data, goodwill, or business interruption arising from or related to the use of CapShip.

To the maximum extent permitted by applicable law, CapShip’s total aggregate liability arising from or relating to a purchased product will not exceed the amount you paid for the CapShip product giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold CapShip harmless from third party claims, damages, liabilities, and reasonable costs arising from your unlawful use of CapShip, your applications or content, your violation of third party rights, or your material violation of these Terms.

This section does not require you to indemnify CapShip for claims arising solely from CapShip’s own unlawful conduct where such liability cannot be transferred under applicable law.

13. Suspension and Termination

CapShip may suspend or terminate access to future downloads, updates, support, license services, or other CapShip controlled services if we reasonably determine that you have materially violated these Terms, including through unauthorized redistribution, piracy, license sharing, or infringement of CapShip’s intellectual property.

Termination does not transfer ownership of CapShip intellectual property to you or authorize continued prohibited use or redistribution.

Rights in applications and original work you lawfully created before termination remain yours, subject to applicable law and third party licenses.

14. Governing Law, Changes and Contact

These Terms are governed by applicable law. Any mandatory rights available to consumers under the laws applicable to them remain unaffected.

We may update these Terms from time to time. Material changes will apply prospectively unless applicable law requires otherwise. The current version and effective date will always be published on this page.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
